GENERAL BROKERAGE
A. A “For Sale By Owner” transaction may
require the needs of a professional brokerage company
to assist the property owner, whether at time of offering
by submission of the property information to the multiple
listing service, at time of receipt of an offer to purchase
the property, or thereafter as necessary to assist the
seller through the real estate transaction until conclusion
at time of the real estate closing. Traditionally, these
services, considered full brokerage services, are at a
cost of approximately six percent (6%) of
the property sales price.
B. The New Trend Realty Services® ends upon the receipt
by the property owner of an acceptable offer to purchase
the property or an offer warranting counter-offer. At
this stage of the transaction, which we call Step Two,
you may determine to engage additional services from an
attorney, title company or obtain your own independent
real estate brokerage company to assist throughout the
remaining portion of the real estate sales transaction
at a negotiated fee for those agreed services. If the
accepted offer does not go to settlement, New Trend Realty
will at your request reactivate your listing at no charge.
C. The New Trend Realty Services® are limited in
extent and duration and you are advised to consider engagement
of other professional assistance at time of receipt of
an acceptable offer to purchase your property or an offer
you desire to counter-offer. Your commitment to New Trend
Realty Services® does not obligate you to continue
your brokerage assistance through New Trend Realty, or
any other real estate brokerage company or attorney and
allows you to be truly independent in your efforts to
sell your property as a “For Sale By Owner”
property. New Trend Realty allows the opportunity for
you to make a choice for real estate brokerage services
at a cost less than traditionally incurred by a property
owner in the sale of their home.
D. Due to possible changes in real estate brokerage law
or policies of multiple listing services, the New Trend
Realty Services® are subject to change as necessary
for compliance appropriate to the limited brokerage services
offered. Any change unacceptable to you as a client of
New Trend Realty will give you cause to terminate your
New Trend Brokerage Service Agreement and entitlement
to receive a refund of fees paid and not yet earned by
New Trend Realty.
REVEAL DEFECTS AND ENVIRONMENTAL HAZARDS
A. Seller (including Sellers exempt from the Real Estate
Seller's Disclosure Act) shall disclose all known material
defects and/or environmental hazards on the Seller’s
Disclosure Statement. A material defect is a problem or
condition that:
(1) is a possible danger to those living on the Property,
or
(2) has a significant adverse effect on the value of
the Property.
B. If Seller fails to tell of known material defects
and/or environmental hazards,
(1) Seller will not hold Broker or Licensee responsible
in any way;
(2) Seller will protect Broker and Licensee from any
claims, lawsuits, and actions that result;
(3) Seller will pay all of Broker's and Licensee's costs
that result. This includes attorneys' fees and court-ordered
payments or settlements (money Broker or Licensee pays
to end a lawsuit or claim).
C. Seller will advise Brokers and Buyers of any concerns
with the property, including past, current, and known
future changes that may affect the value of the property.
All such concerns shall be in writing and set forth in
the Seller's Disclosure Statement.
Pennsylvania state law mandates that a completed Seller
Disclosure be given to and signed by buyer(s) prior to their
signing an Agreement of Sale on your property. Please print
Seller Disclosure, complete and give to prospective buyers
or their agents. Obtain a signed and dated acknowledgement
of receipt. If conditions change following completion of
the Sellers Disclosure Statement, you need to revise your
disclosure, deliver to the Buyer, and once again obtain
a signed acknowledgement of receipt. The New Trend Realty
Services® includes our assistance with completion of
your Seller’s Disclosure Statement.
MULTIPLE LISTING AND WEB PAGE SERVICES
Broker's references to multiple listing services and/or web site sources
by name advise only of Broker's current membership or authority to
participate. Broker is not responsible as a guarantor or agent for
the services provided by any third party, including multiple listing
services and/or web site providers. No reference to a third party in
this web site implies or represents that the third party endorses or
has approved the New Trend Realty Services or that they are a
participant in the business activities of Broker.
